  • You are pulled over for DUI and chemical testing showed a blood alcohol content (BAC) of .08 or higher regardless of a DUI conviction.

The rules are even stricter when operating a commercial vehicle. In Illinois your CDL will be disqualified if:

  • You are convicted of DUI.
  • You refuse to submit to chemical testing.
  • You have a BAC of .04 or higher, regardless of a conviction.

Length of Disqualification

Alcohol related offenses are categorized under Major offenses for CDL disqualifications. As a result the period of disqualification is as follows:

  • First offense—1 year (3 years if transporting hazardous materials)
  • Second offense—Life (DUI offenders may be able to reinstate the CDL license after 10 years if they complete a state approved alcohol program)

Reinstatement of CDL

In order to get your CDL reinstated, you will need to wait until the disqualification period is over. If you wish to fight your disqualification, you can contest the disqualification at a hearing with the Illinois Secretary of State. This is separate from any criminal DUI court proceedings.
